This is a continuation of my previous post, and the story continues here.....
The next week was a rush of getting the solicitor to get the papers ready to sign, inspections organised and completed before we sign the sale deed. At this point I must tell you a few things, remember I said speak to the sales agent, 1. Ask him every question you have, there is nothing wrong in that. 2. Once you put in your offer, call your mortgage agent and tell him to be on standby to get the mortgage papers ready to sign if your offer is accepted. 3. Get a solicitor to get the sale deed ready and organize an inspection to make sure the property is worth investing in. I must also add, solicitors can charge you a little more than the process is worth so negotiate a little with them, also, they can be a bit slow, so call them to make sure things are going smooth.
Everything went smooth, the deposit for the property was put down, the name changed happened and after two months the entire sale was transferred and the house was finally ours, the owners now became renters for the next two months and were to vacate in September 2015. Or so we thought!!
Here comes the twist to our house buying story..... Towards the middle of September, our rental agent mailed the previous owners to let them know the rental agreement was coming to an end and they needed to vacate, but these people had plans to stay on and did not reply to the mail. This was bad news! We asked our agent to let them know that they could stay until the end of September and not November as they wished. To this we did not get a reply from them. We were wondering what to do and checked around, the only answer to this situation was 1.Agree to their wish or 2.Get a date for a Tribunal hearing to get them to legally vacate the property. We decided to go ahead with the second option as we needed to move in as we had found someone to rent our apartment and that person was to move in end of September. We did not get a hearing date until the mid of September. Luckily the person moving into our apartment was willing to wait until things sorted out.
To cut the long story short an agreement was drawn that the occupants would move out on October 23rd and the Judge said we can call the police on them if they did not vacate. Now this is a learning point, as we have never been to a court house here in Australia and wondered how the proceedings go and I hope it will be helpful if ever you are in this situation. First off, this a hearing where the Judge asks both parties to come to an agreement, in the court room it is the rental agent who can do all the talking. If the owner and the lessee do not come to an agreement within the time given by the judge then a legal date is fixed and this date is available only after two to three months! So I would say 'Come to an agreement and get the judge to sign the date authorizing you to call the police to get them to vacate if they do not leave on the said date!'
So finally our journey came to an end on October 23rd and we are finally enjoying this beautiful house that we now call our home. It is our biggest blessing this year to have a house that my daughter calls hers.... It's HOME SWEET HOME....
